1903/44 Rex vs. Ki Chung – attempt to murder

As part of the Chinese Historical Wrongs Legacy Initiative, the BC Archives has digitized a selection of documents related to criminal prosecutions against the Chinese community from 1866 to 1914, found in GR-0419. These are mainly records created as part of the preliminary hearing held before a judge in order to determine whether there was sufficient evidence to proceed to trial. There are often lengthy witness statements, and cross examinations by both prosecution and defense lawyers. The eventual verdict is sometimes recorded on the outside of the docket. They offer a fascinating glimpse into 19th and early 20th century criminal activity around the province, and ways in which the Chinese community was stereotyped. Indictable Offences

(V) Section 596 Warrant of Commitment

CANADA PROVINCE OF BRITISH COLUMBIA County of KOOTENAY

To the Constable of KOOTENAY, and to the Keeper of the Jail WEML at Kamloops, in the County of Yale

WHEREAS Ki Chung was this day charged before Me WEM Lauchlin one of His Majesty's Justices WEML of the Peace in and for the said County of KOOTENAY, on the oath of T.W. Bain of Revelstoke. and others for that He did Commit an assault with intent to murder on Wang Depp Chong at Clan William on Saturday January 23d 1903 by cutting him the aforesaid Wang Depp Chong with an axe on the head and other injuries to him did do

These are therefore to command you the said Constable to take the said Ki Chung, and safely convey to the Common Gaol at Kamloops aforesaid, and there to deliver him to the Keeper thereof, together with this precept: And I do hereby command you the said Keeper of the said Common Gaol to receive the said Ki Chung into your custody in the said Common Gaol and there safely keep him until he shall be thence delivered by due course of law.

GIVEN under My hand and seal this 10th day of February, in the year of Our Lord one thousand nine hundred and three at Revelstoke, in the County aforesaid.
