1866/3 R. vs. Kim Foo and Ah Soo, receiving stolen goods belonging to the Pemberton family
As part of the Chinese Historical Wrongs Legacy Initiative, the BC Archives has digitized a selection of documents related to criminal prosecutions against the Chinese community from 1866 to 1914, found in GR-0419. These are mainly records created as part of the preliminary hearing held before a judge in order to determine whether there was sufficient evidence to proceed to trial. There are often lengthy witness statements, and cross examinations by both prosecution and defense lawyers. The eventual verdict is sometimes recorded on the outside of the docket. They offer a fascinating glimpse into 19th and early 20th century criminal activity around the province, and ways in which the Chinese community was stereotyped. Information
Colony of Vancouver Island and its Dependencies, To Wit:
The information and complaint of Arthur Taylor of Victoria in the Colony aforesaid, taken this 14th day of March in the year of our Lord one thousand eight hundred and sixty six before me Augustus F. Pemberton Esq. one of her Majesty's Justices of the Peace for the said Colony of Vancouver Island and its Dependencies, who being sworn upon his oath, saith
on the morning of the twenty eighth of February last past I was on duty at Swan Lake near Victoria in the colony aforesaid in the house in which I arrested the prisoner charged with having committed the robbery at Mr Coplands. I found the bag which I produce in court, in it I found some pieces of silk, produced, which corresponded with some stolen from the house of Mr. J.D. Pemberton sometime since, the prisoner Kim Foo told me at the time he was arrested that the bag was his property. I charge the prisoner Kim Foo with receving the silk well knowing the same to have been stolen.
