James Richardson, 19 Hastings street, Vancouver,;-I remember the morning of the 8th instant; I dropped into the Avenue hotel that morning about a quarter to nine on my way to the stable; the accused and the bar tender, Alex. Holland were the only people in the bar; no one else came in while I was there; I was standing in front of the bar, and the Chinaman came in at the end of the bar with a tray with empty glasses on; the bar tender asked him where was the money for the drink he had delivered; he answered that they did not pay him; the bar tender said that was all right; the accused gave another order for drinks, and the accused got saucy after the order was filled; Holland turned to me and said I don't know what has got into the Chinaman this morning. He said to the Chinaman: You keep out of the bar and I will pay you your money when I get through with this order; at the same time he turned to me and asked me to deliver the order to room 4; I took the tray and took it to room 4; when I started out the bar tender had turned around facing the cash register; the accused was at the end of the bar, outside of the bar; he had been pushed out from inside the bar a couple of times by the bar tender; the accused had tried to get in behind the bar a couple of times; he appeared to be in an awful rage; the bartender had not used any unnecessary force in putting him from behind the bar; he just said; you keep from behind the bar till I will pay you; I had Just got up one flight of stairs and delivered the order; when I was delivering it I heard the Chinaman scream; I did not understand what he
